Terms & Conditions

These Terms constitute an electronic record under the Information Technology Act, 2000 and form a binding contract under the Indian Contract Act, 1872 between you and Bid My Ride Auction, having its registered office at Habib Nagar, Shastripuram, Hyderabad 500064, Telangana.

Acceptance and eligibility

By registering, browsing or bidding you accept these Terms. You confirm you are at least 18 years of age and competent to contract under Section 11 of the Indian Contract Act, 1872, and that you are resident in India or otherwise permitted to transact under the Foreign Exchange Management Act, 1999.

Registration and KYC

Access to live auctions requires completion of Know Your Customer verification with a valid PAN, Aadhaar or passport and, for dealers, a GSTIN. We may refuse, suspend or cancel registration where documents are incomplete, unverifiable or suspected to be in breach of the Prevention of Money-Laundering Act, 2002.

Nature of our service

Bid My Ride Auction operates as an intermediary auction platform facilitating the sale of vehicles between sellers and registered buyers. Except where we are expressly named as the seller, title in the vehicle passes directly from the seller to the successful bidder and we act only as agent for the conduct of the auction.

Bids, reserve price and acceptance

  • Every bid is an irrevocable offer and cannot be withdrawn once submitted.
  • Lots may carry a confidential reserve; bids below reserve create no contract.
  • A binding contract arises only when we issue a written sale confirmation to the highest eligible bidder.
  • We may withdraw a lot, reopen bidding on a technical failure, or reject bids placed through automated means not authorised by us.

Payment, fees and taxes

All amounts are quoted in Indian Rupees (₹) and are exclusive of applicable Goods and Services Tax, which is charged at rates prevailing under the Central Goods and Services Tax Act, 2017 and Telangana GST Act, 2017. The buyer must remit the winning bid, buyer’s premium and taxes within the period stated in the sale confirmation. Late payment attracts interest at 1.5% per month, and default may result in forfeiture of the security deposit and cancellation of the sale.

Vehicle condition and “as is, where is” sale

Vehicles are sold on an “as is, where is” basis. Inspection reports, photographs and odometer readings are provided in good faith and reflect the condition observed at the time of inspection; they do not constitute a warranty. Buyers are urged to inspect a lot before bidding. Nothing in this clause limits rights that cannot be excluded under the Consumer Protection Act, 2019.

Registration transfer and delivery

Transfer of ownership is completed through the Regional Transport Office under the Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989. The buyer is responsible for road tax, re-registration charges in the destination state, and for obtaining valid insurance before taking the vehicle on a public road. Risk in the vehicle passes to the buyer on delivery or on expiry of the free storage period, whichever is earlier.

Cancellations and refunds

Given the auction nature of the sale, confirmed bids are non-cancellable. Where we cancel a lot for reasons attributable to us or the seller, deposits are refunded to the original payment instrument within 10 business days.

Prohibited conduct

Bid rigging, collusion, shill bidding, misuse of another person’s credentials, scraping and any activity prohibited under Section 43 or 66 of the Information Technology Act, 2000 or the Competition Act, 2002 are strictly forbidden and may be reported to law enforcement.

Limitation of liability

To the maximum extent permitted by Indian law, our aggregate liability arising out of or in connection with any transaction is limited to the commission or buyer’s premium actually received by us on that transaction. We are not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control.

Governing law and jurisdiction

These Terms are governed by the laws of India. Disputes shall first be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Hyderabad, with proceedings in English. Subject to arbitration, the courts at Hyderabad, Telangana shall have exclusive jurisdiction.

Grievance Officer

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, complaints may be addressed to our Grievance Officer, who responds within 48 hours and resolves within one month.
